Art. 1: Acceptance of the conditions
The following terms and conditions shall apply to all offers and deliveries made by the company and to all agreements concluded between the company and the customer, unless the company has requested a different agreement in writing.
The customer’s general terms and conditions of purchase are only valid if they correspond to the general terms and conditions of the company or if they have been accepted by the company in writing.
Art. 2: Prices
The customer is strictly bound to pay the price. Any increase in this price between the time the agreement is entered into and the time of delivery will be passed on to the customer. The company is in any case entitled to apply a proportional price increase in case of circumstances independent of its will, such as an increase of duties and excise duties on the products to be delivered, an increase in freight rates, an increase in the prices of the basic products, increase of labor wages as a result of legal provisions or national or sectoral CLAs, changes in currency, etc. after the conclusion of the agreement.
The payment of any possible surcharge on the basis of the provisions of this article shall be equal to the principal sum.
V.A.T. and any other taxes not mentioned or included in the price as well as the transport and packaging costs shall be borne by the client.
Art. 3: Payment
All products are payable in cash at Rue des Saules 62, 1380 Lasne, Belgium. On site in Lasne one can pay with Bancontact or credit card unless otherwise agreed in writing. All payment costs are to be borne by the customer.
All payments can be made via our secure site at www.gharaee.com via Mollie (Bancontact, Visa, PayPal, credit card, …).
Art. 4: Delivery and acceptance
Regardless of what has been agreed with regard to the freights and other costs and who is responsible for the shipment, the goods always travel at the customer’s risk.
After the expiry of the expressly agreed delivery times, the goods are always at the risk of the customer, even if they are in the company’s warehouses. The customer shall examine the ordered goods for quality and quantity immediately upon delivery and at the latest upon arrival at the destination if the goods are being transported.
The client shall notify any defects or shortcomings in writing immediately after he discovers them or should have discovered them by mentioning them on the delivery note and in any case by written confirmation within 24 hours after he discovers them or should have discovered them. Complaints that reach the company afterward will no longer be accepted. In the event of any complaint, the company must be given the opportunity to check the goods delivered. This applies under the penalty of forfeiture of all rights.
Art. 5: Right of withdrawal
Dear customer, before using this option, please discuss this with Gharaee.com in writing.
If the customer exercises his right of withdrawal, the product must be returned in its original packaging, in good condition, with all delivered accessories, and – to the extent possible – in its original condition and packaging with all documents (proof of purchase and order or delivery note).
Gharaee.com products are delivered at the best temperature. If the order does not correspond to the desired quality, please contact the relevant service via our e-mail address or via the number +32486/03.55.57.
Art. 6: Intellectual property
The Buyer expressly acknowledges that all intellectual property rights linked to the information provided, the communication, or other statements concerning the products and/or the Website are the property of gharaee.com, its subcontractors, or other entitled parties.
The names and logos of the Website, the Vendor, and the names of related companies mentioned on the Website are names and trademarks protected by national and international laws. The user’s rights, reproduction rights and intellectual property rights of the Website are the exclusive property of the Vendor, one of its subsidiaries or a third party. They may not be reproduced or made public without the express prior written consent of the Vendor, one of its branches, or a third party concerned.
Art. 7: Delivery, prices, and orders
Orders can be placed on the website www.gharaee.com or by calling +32486/035557 from 9 a.m. to 4 p.m. Monday to Friday (inclusive).
All products depart from Lasne (1380). Deliveries within a radius of 15 km are free from €150.
Deliveries in Brussels and its 19 towns are free from €150.
For deliveries < 150€, a fixed price of 20€ will be charged to the customer.
Deliveries outside Brussels will be charged at 1,25€ VAT incl. per km (starting from 1380 Lasne).
If the customer wishes a VIP delivery, please organize it with customer service via gharaee.com.
Deliveries in Belgium can take up to 48 hours.
